Copyright
We will not copy material that has copyright. By submitting material to us for transfer to digital files, you confirm that you have the relevant authority to do so and that you are the copyright holder or have obtained written permission from the relevant copyright holder / distributor to have the transfer done. We will not be held responsible for any breaches to copyright arising from the transfer of any material to digital formats. We provide our services under the assumption that the format is being shifted from tape / analogue to digital and that the customer will retain the original tape / film as proof of existence and / or ownership.
Data Retention
We do not retain customer data indefinitely. The customer is expected to make backup copies of all data and adhere to data storage best practice and policies. We will retain data for a short period (usually 28 days) thereafter all data relating to the job will be deleted. It is the customers responsibility to check that the files are backed up. We recommend multiple backup copies on local, external and cloud services.
Download Links
Download links are not a permanent data storage solution. These are temporary links and will be deleted (without notice) 28 days after the work is completed. The customer is expected to download and store the relevant files on their choice of online and / or offline storage platforms. By default, we will send a download link using Microsoft OneDrive and the link will be accessible by anyone with the link. If you require a private download / password protected option, please advise prior to us doing the work.
Non disclosure agreements
We are happy to sign NDA’s in the event of sensitive or confidential information.
Tape Damage
Our VTR’s and playback equipment is maintianed on a regular basis. Tape is a fragile medium and is easily affected by moisture and incorrect storage. We will assess tapes prior to commencing the digitisation process. Any damaged or dirty tapes may be refused or may be subject to additional charges to cover cleaning and tape preparation. We do not accept any liability or responsibility for tapes that are damaged by our machines due to factors such as moisture, mould, oxide shed, or any other factor that could be as a result of incorrect storage.
Limit of liability
We have a limit of liability that extends only to cover the cost of the actual cassette / tape / USB drive or hard drive. We do not accept any liability for any data on any device or video footage on any tape / film. Our limit of liability is $100.00 (one hundred NZ dollars) for any single incident and is limited to the replacement cost for an individual tape (if commercially available), USB drive or hard drive. This limit of liability extends to total loss in the event of natural disaster, fire, flood and theft and any other event beyond our control.
All reasonable precautions are taken to prevent any damage to customer material. However, it is the customers responsibility to ensure that the goods / materials are insured / covered for any incident.
Payment
Unless otherwise arranged prior, all payment is due on collection of the work undertaken. In the case of large institutions or companies, we will accept an official purchase order. In this case payment is due on the 20th of the month following the work. This may be subject to an application for credit.
Privacy
All data is recorded on standalone machines that are not connected to a wide area computer network. All reasonable precautions are taken to ensure data is secure. We have a limit of liability (see above) for data loss and cyber-attacks.
Items not collected
Any items not collected within 6 months of the completion of the work will be discarded. If you do not require your old tapes, we will dispose of them responsibly in accordance with current waste disposal / recycling policies. We may retain cassette cases and shells as spare parts.
Courier
By default, all goods will be shipped within New Zealand using a NZ Post Signature required delivery service. We are not responsible for delays or losses incurred by NZ Post. Our responsibility for delivery of the material ceases upon collection of the parcel / package from our address. Any other courier options are the customers responsibility.
Objectionable material
We reserve the right to refuse to copy or transfer material that we feel is objectionable or is in breach of any local or international law. We will use our discretion in determining this.
